These Terms & Conditions govern your access to and use of habitualservices.com (the “Site”) and your purchase of products from us. By using the Site or placing an order, you agree to these terms. Please read them carefully.

1. About us

The Site is operated by Habitual Industries Pty Ltd (ABN 64 428 568 353). We supply commercial cleaning and hygiene products to businesses and the public across Australia.

2. Orders and acceptance

  • Placing an order is an offer to buy. A contract is formed only when we accept and confirm your order. We may decline or cancel an order at our discretion (for example, stock unavailability, pricing errors, or suspected fraud), and will refund any payment already made for a cancelled order.
  • You are responsible for ensuring your order details, delivery address and contact information are correct.

3. Pricing and payment

  • Prices are in Australian dollars (AUD). Unless stated otherwise, prices are shown excluding GST; GST is applied at checkout where applicable.
  • We try to keep pricing accurate but errors can occur. If we discover a pricing error after you order, we’ll contact you to confirm whether you wish to proceed at the correct price or cancel for a full refund.
  • Payment is required at the time of order unless you hold an approved trade account with agreed terms (see section 4).

4. Trade accounts

  • Trade accounts are offered at our discretion, subject to application and approval.
  • Approved trade accounts may be granted credit terms (for example, payment within 30 days of invoice — “Net 30”). The specific terms in your trade account agreement prevail.
  • We may suspend or withdraw a trade account or credit terms where payments are overdue or terms are breached. Overdue amounts may incur recovery costs as set out in your trade account agreement.

5. Delivery

  • We deliver Australia-wide. Delivery times and costs are estimates and shown at checkout or quoted for trade orders.
  • Risk in the goods passes to you on delivery. Title to the goods remains with us until payment is received in full.
  • We are not liable for delays caused by carriers or events outside our reasonable control.

6. Hazardous goods and product safety

  • Many products we supply are chemicals or hazardous goods. You are responsible for handling, storing, using and disposing of products safely and lawfully, including reading the relevant Safety Data Sheet (available in our SDS Library) before use.
  • You must ensure products are suitable for your intended use and used only by appropriately trained persons where required.
  • Some products may have shipping restrictions or require compliant carriage; we’ll advise where this affects your order.

7. Returns and refunds

Returns and refunds are governed by our Refund & Returns Policy, which forms part of these terms. Your rights under the Australian Consumer Law are not limited by these terms.

8. Consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, and except for rights and remedies under the Australian Consumer Law that cannot be excluded:

  • Our liability for any product or the Site is limited, at our option, to replacing or repairing the goods, resupplying equivalent goods, or refunding the price paid.
  • We are not liable for indirect, incidental or consequential loss, including loss of profits or business interruption, arising from your use of products or the Site.

10. Intellectual property

All content on the Site (logos, text, images, design) is owned by or licensed to us and may not be copied, reproduced or used without our written permission, except as permitted by law.

11. Your use of the Site

You agree not to use the Site unlawfully, to interfere with its operation, or to attempt unauthorised access. We may suspend or restrict access where these terms are breached.

12. Privacy

We handle personal information in accordance with our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. The version published on the Site at the time you place an order applies to that order.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
